Transgender service members and rights groups file suit against Trump’s Pentagon directive

A group of transgender service members and rights groups are filing a lawsuit against President Donald Trump’s restrictions on transgender troops in the military.

The lawsuit, filed on behalf of six active duty transgender service members by GLAD Law and the National Center for Lesbian Rights (NCLR), argues that the new executive order violates the equality guarantees of the U.S. Constitution.

Filed in U.S. District Court for the District of Columbia, the suit says the six transgender service members would lose access to healthcare and retirement benefits as a result of the executive order.

“When you put on the uniform, differences fall away and what matters is your ability to do the job,” said Army 2nd Lt. Nicolas Talbott, named as plaintiff in the suit: Talbott v. Trump.

The new order, signed by Trump on Monday evening, requires Defense Secretary Pete Hegseth to update medical standards to ensure they “prioritize readiness and lethality” and take action to “end the use of invented and identification-based pronouns” within DOD.

It says that expressing a “gender identity” different from an individual’s sex at birth does not meet military standards.

The order also restricts sleeping, changing and bathing facilities by biological sex. It’s not an immediate ban, but a direction for the secretary of Defense to implement such policies.

It revokes former President Joe Biden’s executive order that the White House argues “allowed for special circumstances to accommodate ‘gender identity’ in the military – to the detriment of military readiness and unit cohesion.”

The categorical ban on transgender service members was lifted in 2014 under President Barack Obama.

“I’ve been military my entire life. I was born on a military base,” said Navy Ensign Dan Danridge, student flight officer, a plaintiff in the suit.

“Every day I lace up my boots the same as everybody else. I pass the same tests as everybody else. Being transgender is irrelevant to my service. What matters is that I can complete the tasks that are critical to our mission.”

“I’ve spent more than half my life in the Army, including combat in Afghanistan,” said Army Sgt. 1st Class Kate Cole. “Removing qualified transgender soldiers like me means an exodus of experienced personnel who fill key positions and can’t be easily replaced.”

Trump’s new order builds on another directive he issued last week that revoked a Biden-era order allowing transgender people to serve in the military.

On the campaign trail, Trump promised to reinstate the ban on transgender troops he imposed during his first term. In his inauguration speech, he said he would formally recognize that there are only two genders: male and female.

There are an estimated 9,000 to 14,000 transgender service members – exact figures are not publicly available.

Between Jan. 1, 2016, and May 14, 2021, the DOD reportedly spent approximately $15 million on providing transgender treatments (surgical and nonsurgical) to 1,892 active duty service members, according to the Congressional Research Service.

The move comes as part of a campaign taken up by Trump and Hegseth to weed out any diversity, equity and inclusion (DEI) practices across the military. And GOP lawmakers successfully included an amendment in their 2025 defense policy bill that bans irreversible transgender care for minors in the military healthcare system.

Trump to reinstate service members discharged for not getting COVID-19 vaccine

President Donald Trump will sign an executive order to reinstate service members booted from the military for declining to get COVID-19 vaccine jabs, according to the White House.

Those reinstated will be returned to their prior rank, and be provided back pay and benefits.

The White House fact sheet indicates that just 43 of the over 8,000 service members discharged over their COVID-19 vaccination status opted to return to the military.

ICE arrests 3 Tren de Aragua gang members in mass deportation push

U.S. Immigration and Customs Enforcement (ICE) this week arrested three Venezuelan Tren de Aragua gang members in two states as the new administration begins its mass deportation push, a senior Trump administration official told Fox News.

Nestor Jose Mendoza-Garcia was nabbed Thursday in San Antonio, Texas, and Elmer Aparicio-Castillo and an unidentified 36-year-old man were arrested the same day in Nashville, all after allegedly entering the country illegally last year when they were processed and arrested by the Biden administration.

“Throughout this week, the heroes of ICE have been hunting down and arresting hundreds of illegal alien criminals, and it’s immediate expulsion, including those with charges of convictions for rape, child sexual assault, terrorism and even murder,” President Donald Trump said at a rally in Las Vegas Saturday.

“Members of the savage Venezuelan prison gang known as Tren de Aragua. You know that gang? This is not a nice group of people. They formed in prison, and then [Venezuela] dumped their prisons into our country.

“They’re as bad as the bloodthirsty MS-13 gangs.”

Mendoza-Garcia arrived in the U.S. in October and was issued a notice to appear before being released.

He was arrested by the San Antonio Police Department in November for possessing a gun linked to an unsolved murder.

On Thursday, ICE San Antonio obtained a federal indictment and arrest warrant for Mendoza-Garcia for being an alien in possession of a gun. He is an active member of the gang, the official said.

Aparicio-Castillo was issued a notice to appear after an encounter with ICE in El Paso, Texas, in September.

He was arrested by ICE Nashville Thursday for allegedly being an alien in possession of a gun. He also allegedly has links to the gang.

Aparicio-Castillo’s criminal history includes charges of evading arrest, promoting prostitution and marijuana possession in Nashville.

After his criminal adjudication, Aparicio-Castillo will be administratively arrested for immigration proceedings, the official said.

The 36-year-old unidentified Venezuelan entered the U.S. illegally through Eagle Pass, Texas, in December and was issued a notice to appear.

Fox News embedded exclusively with Immigration and Customs Enforcement (ICE) in Boston as the agency targeted egregious criminal aliens, including MS-13 gang members and murder suspects, as part of mass deportation efforts under President Donald Trump.

Fox News witnessed ICE Boston make eight arrests, including multiple MS-13, Interpol Red Notices, murder and rape suspects, and a volatile Haitian gang member with 18 convictions in recent years who told our cameras that he “ain’t going back to Haiti” and “f— Trump, Biden forever!”

“Today was a good day. Today we took several significant public safety threats out of our communities,” Patricia Hyde, ERO Boston Acting Field Office Director, told Fox News. “Unfortunately, a lot were released by sanctuary policies. But we’re here to tell the Commonwealth and the rest of the country that we’re going to find them, whether they’re released or not.”

ICE also made what is known as a “collateral” arrest, where ICE arrests an illegal alien who wasn’t their initial target.

In that case, the illegal alien was with an MS-13 gang member who had been released by a sanctuary jurisdiction on Tuesday with an ICE detainer that was not honored.

Trump’s border czar Tom Homan has previously warned that collateral arrests are something that would happen in sanctuary jurisdictions.

As ICE Boston was arresting a violent illegal alien in one neighborhood, Fox News heard a woman yell out “thank you” to the agents.

The arrests come as the Trump administration moves rapidly to fulfill its promise to launch a historic mass deportation operation, which it has said will focus primarily – but not exclusively – on public safety threats.

In the first days of the Trump administration, ICE has made more than 460 arrests of illegal immigrants, including those with criminal histories that include sexual assault, domestic violence and drugs and weapons crimes. Arrests took place across the U.S. including Illinois, Utah, California, Minnesota, New York, Florida and Maryland.

Agents arrested nationals from a slew of countries, including Afghanistan, Angola, Bolivia, Brazil, Colombia, Dominican Republic, Ecuador, El Salvador, Guatemala, Honduras, Mexico, Nicaragua, Senegal and Venezuela.
