    China-linked firm gets EZ pass contract in New Jersey; ‘worse’ than TikTok

    The major U.S. tolling company that was sold to a Singapore-based firm under the Biden administration is reigniting national security concerns over its links to China, after it won the E-ZPass contract for the New Jersey Turnpike for $250 million more than the American company that has operated it for 22 years.

    In September, the New Jersey Turnpike Authority awarded TransCore – owned by Singapore Technologies Engineering, known as ST Engineering – the full authority to run the operation for $1.73 billion, beating out Newark’s Conduent, Inc., whose final offer was $1.479 billion.

    Now, Conduent is crying foul, questioning the reasoning behind TransCore winning the contract it held for over two decades – and the risks the decision could carry.

    Conduent filed an appeal over Nashville-based TransCore’s award, voicing concerns that owner ST Engineering’s parent company, Temasek Holdings, is wholly owned by the government of Singapore, with substantial ties to China.

    Until recently, Fu Chengyu, a longtime chairman of state-owned Chinese oil companies – whom the protest points to as a high-ranking member of the Chinese Communist Party (CCP) with connections to China’s United Front – was a member of Temasek’s board of directors.

    In 2022, The Washington Free Beacon reported Fu “served on the Chinese People’s Political Consultative Conference…a major hub of China’s united front system, which carries out foreign influence operations for the Chinese Communist Party.”

    Although Fu stepped down from the board about six weeks after Conduent’s initial protest, he remains influential within Temasek as a director of a China-specific subsidiary of the company, according to the investment firm’s announcement of his departure from the board.

    When ST Engineering was seeking approval from the Treasury Department’s Committee on Foreign Investment in the United States (CFIUS) to acquire TransCore in 2021, a spokesperson from the company insisted that it operates “without any interference from the government or Temasek,” but national security experts warned that if the deal went through, it could mean TransCore’s data could end up in the hands of Singapore, China, and potentially other nations.

    Individuals, businesses and government entities that sign up for automatic payments at toll booths provide sensitive information – including addresses, credit card numbers, driver’s license information and license plate numbers – to tolling operators such as TransCore, which, as of that time, handled some 70% of the tolls paid in the U.S. The company has won more U.S. contracts since its acquisition.

    Exposing Americans’ data to foreign adversaries has become a greater concern since then. Last year, Congress passed a law ordering video sharing app TikTok, owned by Chinese firm ByteDance, to divest or shut down in the U.S. over security risks, given that the CCP requires companies to provide it access to their data.

    Former U.S. Senator Robert Torricelli (D, N.J.), who is a consultant to Conduent, said that the situation with a foreign-owned company like TransCore having access to America’s tolling systems is “worse” than the threat from TikTok.

    “I don’t really understand why this hasn’t gotten a lot, frankly, a lot more attention,” Torricelli told FOX Business in an interview. “I would rather the Chinese knew what I was watching on TikTok than have the Chinese monitoring my car going up and down the New Jersey Turnpike. I don’t really understand why people aren’t more upset about it.”

    The New Jersey Turnpike is one of the busiest highways in the U.S., and is a principal artery between the major cities on the East Coast.

    Torricelli warned that every major U.S. government official traveling between New York and Washington, D.C., could potentially have their transportation patterns monitored if TransCore secures the contract to run it. He said that important cargo like chemicals and even U.S. military equipment and movements could be routinely tracked. 

    “There has to be some national security concern here,” the former senator said. “It is enormously more important than whatever nonsense is going on with TikTok, but it largely has been under the radar.”

    The New Jersey Turnpike Authority (NJTA) declined to comment when asked by FOX Business whether the commissioners were concerned about the potential for E-ZPass customers’ data being obtained by the governments of Singapore and China, and the reasoning behind awarding TransCore a contract that cost $250 million more than their competitor’s lower bid.

    A spokesperson for the NJTA noted that Conduent’s protest of the E-ZPass contract award is still being decided, and said the Turnpike Authority is not going to comment before the process is concluded and issued a final agency decision.

    TransCore’s president and CEO, Whitt Hall, told FOX Business in a statement that the company has been based in the U.S. for its entire 85-year history. He said TransCore “has always been absolutely transparent about its ownership structure,” and “is the only toll system provider in the world to manufacture all of its tolling products within the U.S.”

    “TransCore delivers the most secure toll systems in the U.S. through a multi-tiered approach of best-in-class system design, strict compliance with all state and agency-specific data and cybersecurity requirements, and its National Security Agreement (NSA) that is in place with the U.S. Departments of Justice and Treasury to assure that no personally identifiable information or protected data collected is ever accessible by or shared with any foreign entity or affiliate,” Hall said. “Any allegations to the contrary are false.”

    When TikTok was trying to convince the U.S. government to allow it to keep operating in the U.S. despite its Beijing-based ownership, the social media company invested $1.5 billion in securing Americans’ data in the U.S. with backups in Singapore, vowing to fully pivot to U.S.-based data storage. 

    Despite that, Congress passed a law requiring them to divest or be shut down.

    Former Sen. Torricelli believes TransCore deserves further scrutiny.

    “If, indeed, we ever got to a point of high tension with the Chinese, they would be monitoring our most important internal transportation,” he told FOX Business. “It would be inconceivable that an American corporation would be allowed to have access to the internal travel of Chinese government officials and sensitive information and goods –  inconceivable.  I don’t blame the Chinese, they’re not at fault. It’s us.”

    Daniel Penny lands role at firm to ‘learn the business of investing’: report

    Daniel Penny, who in December was acquitted of criminally negligent homicide for a chokehold in response to a man’s violent outburst of death threats against other riders on a New York City subway car, has reportedly landed a role with an investment firm in Silicon Valley to “learn the business of investing.”

    The Free Press reported that Penny was hired by Andreessen Horowitz, after seeing an internal statement in which David Ulevitch, a partner at the firm, confirmed the news.

    “He will learn the business of investing, and he will work to support our portfolio companies,” Ulevitch wrote in a memo to all employees on Tuesday afternoon.

    Andreessen Horowitz did not respond to FOX Business’ request for comment on the matter.

    The news comes less than two months after Penny’s acquittal in a high-profile and controversial manslaughter trial. Prosecutors asked the court to dismiss the top charge of manslaughter to avoid a hung jury, and jurors ultimately found Penny not guilty of the lesser charge.

    Penny, a 26-year-old Marine veteran and architecture student, was charged for the subway chokehold death of Jordan Neely, a 30-year-old homeless man with schizophrenia who barged onto the train shouting death threats while high on a type of synthetic marijuana known as K2. It happened on May 1, 2023.

    Neely had a lengthy criminal record, an active arrest warrant, a history of psychosis and was high. He also had sickle cell trait genetic disorder.

    The Free Press reported that Ulevitch spoke about the May 2023 incident in a memo to staff.

    “I believe, as I know many of you do, that Daniel acted with courage in a tough situation,” Ulevitch said. “He was acquitted of all charges. Beyond that, it has always been our policy to evaluate the entire person and not judge them for the worst moment in their entire life.”

    He also wrote about his vision for the former Marine, noting that he could help strengthen the firm’s relationships with the public safety sector and the Department of Defense.

    Specifically, Penny will reportedly work in Andreessen Horowitz’s American Dynamism practice, which “invests in founders and companies that support the national interest.”

    Former House Speaker Kevin McCarthy has joined forces with five other figures to found Watchtower Strategy, a public affairs organization.

    The other people involved include Jeff Miller, Dan Conston, Arthur Schwartz, Cliff Sims and Brian Walsh.

    “Watchtower Strategy is a premier public affairs firm founded by six leaders at the pinnacle of American politics. Watchtower specializes in strategy, advocacy, and crisis communications,” the organization’s website declares.

    Fox News Digital attempted to reach out to McCarthy for comment on Wednesday but did not receive a response in time for publication.

    “The launch of Watchtower Strategy comes at a pivotal and promising moment for our country,” McCarrthy said, according to the press release. “Navigating this moment can be both an opportunity and a challenge. The Watchtower team is trusted, tested, and built for success.”

    McCarthy, Watchtower Strategy’s chairman, is also a member of the C3 AI advisory board, and he is on the Anivive Lifesciences board of directors. 

    C3 AI’s website says the organization “is a leading Enterprise AI software provider for accelerating digital transformation.” 

    Anivive has described itself as a “pet pharmaceutical company.”

    McCarthy obtained the speaker’s gavel in 2023 after a whopping 15 rounds of balloting. He was later ousted from the speakership, and eventually resigned from Congress before the end of his term.

    Top law firm Sullivan & Cromwell to represent Trump in ongoing legal matters

    EXCLUSIVE: President Donald Trump has retained counsel from top law firm Sullivan & Cromwell to represent him in his ongoing appeal efforts in the cases brought against him by Manhattan District Attorney Alvin Bragg and New York Attorney General Letitia James, Fox News Digital has learned. 

    The move comes after his original legal team on the cases joined his administration in top roles.

    The president will be represented by Sullivan Cromwell co-chair and partner Robert J. Giuffra Jr. 

    Giuffra has been at the firm since 1989 after serving as a law clerk to U.S. Supreme Court Chief Justice William Rehnquist. Giuffra currently focuses on securities, white collar criminal, product liability, commercial, insurance, banking and tax litigation. 

    Trump also will be represented by Matthew Schwartz, a partner of the firm who joined in 2007 after clerking for Justice Samuel Alito; Jeffrey Wall, another partner who served as an acting U.S. solicitor general and has argued more than 30 cases in the U.S. Supreme Court; James McDonald, a partner who served as an assistant U.S. Attorney in the Southern District of New York; and Morgan Ratner, a partner who has argued nine cases before the U.S. Supreme Court and who served in the Office of Solicitor General at the Justice Department. 

    Fox News Digital has learned that Boris Epshteyn, Trump’s top legal advisor, is continuing his role as senior counsel, coordinating a wide array of legal fronts and matters for the president. 

    “President Donald J. Trump’s appeal is important for the rule of law, New York’s reputation as a global business, financial and legal center, as well as for the presidency and all public officials,” Giuffra told Fox News Digital. “The misuse of the criminal law by the Manhattan DA to target President Trump sets a dangerous precedent, and we look forward to the case being dismissed on appeal.” 

    The shift comes after the president tapped his former lawyers on the cases to top roles in his administration. 

    Trump appointed his attorney Todd Blanche to serve as deputy attorney general and John Sauer as solicitor general of the United States. 

    Emil Bove, also a Trump attorney tapped for a top role at the Justice Department, is serving as the acting deputy attorney general, but if Blanche is confirmed, Bove will serve as principal associate deputy attorney general.

    DONALD TRUMP SENTENCED WITH NO PENALTY IN NEW YORK CRIMINAL TRIAL, AS JUDGE WISHES HIM ‘GODSPEED’ IN 2ND TERM

    Will Scharf, who also represented the president in these cases, was appointed to serve as staff secretary at the White House. 

    Blanche, Sauer, Bove and Scharf successfully defended the president in former Special Counsel Jack Smith’s investigations into Jan. 6, 2021, and alleged interference in the 2020 election as well as in his classified records case. 

    Sauer argued the case on presidential immunity before the U.S. Supreme Court, leading the high court to rule that presidents have immunity for nonofficial presidential acts.

    Smith’s classified records case was dismissed in July 2024 by U.S. District Court for the Southern District of Florida Judge Aileen Cannon, who ruled that Smith was unlawfully appointed as special counsel. 

    Smith charged Trump in the U.S. District Court for Washington, D.C., in his 2020 election case, but after Trump was elected president, Smith sought to dismiss the case. Judge Tanya Chutkan granted that request.

    Both cases were dismissed. 

    The new legal team will take over Trump’s appeals in both Bragg’s case and James’ case. 

    Trump was sentenced earlier in January by Judge Juan Merchan to an unconditional discharge after being found guilty on charges of falsifying business records. Merchan did not sentence the president to prison, but rather did not impose any punishment at all — no jail time, fines or probation.

    That sentence preserves Trump’s ability to appeal the conviction — which Sullivan & Cromwell will take over.

    As for James’ case against Trump, New York Judge Arthur Engoron, after a weekslong nonjury civil fraud trial, ruled in 2024 that Trump and defendants were liable for “persistent and repeated fraud,” “falsifying business records,” “issuing false financial statements,” “conspiracy to falsify false financial statements,” “insurance fraud,” and “conspiracy to commit insurance fraud.” 

    But before the trial began, Engoron issued a summary judgment against Trump, making the subsequent trial a case over the penalty to be paid.

    Trump appealed the $454 million judgment. The appeal is pending before the New York Appeals Court. 

    Judges on the New York appeals court appeared receptive in 2024 to the possibility of reversing or reducing the $454 million civil fraud judgment.

    The firm made the announcement on Monday – a week after Trump was sworn in as the 47th president.  

    The New York-based firm, which employs about 1,200 lawyers around the world, said Emhoff “brings more than three decades serving as a litigator, trial lawyer, and trusted counsel to clients and global business leaders, as well as extensive experience representing the United States around the world, to Willkie’s broad corporate and litigation platforms.”

    Emhoff will split his time between Los Angeles and New York. The firm said the former second gentleman will also continue to serve as an adjunct professor at the Georgetown University Law Center in Washington, D.C., teaching a course on entertainment law. Days before leaving office, former President Joe Biden appointed Emhoff to serve on the board of trustees to the United States Holocaust Memorial Museum. 

    When Harris was selected as Biden’s running mate in August 2020, Emhoff took a leave of absence from one of the country’s largest law firms, DLA Piper. He formally parted ways with the firm before his wife took office. 

    Emhoff played an influential role in fundraising for his wife’s Democratic bid for the White House against Trump after Biden exited the race. The former second gentleman hosted fundraisers with big law firm donors, as well as his connections in the entertainment industry in California, Reuters reported.

    In its announcement, Willkie Farr & Gallagher stressed how Emhoff has practiced law for more than 30 years and “served as a trusted advisor to companies and leaders in business and technology hubs around the world, managing high-profile disputes and solving complex problems across entertainment, media, sports, technology, and business.” 

    The firm also championed Emhoff’s experience as second gentleman, saying “his broad portfolio included traveling around the world representing the United States, including at the 2024 Olympic Games in Paris, the Women’s World Cup in New Zealand, and numerous other diplomatic events, and leading the administration’s work combatting antisemitism.”

    Citing court records, Reuters reported that Emhoff has represented clients including the creators of the movie “American Made,” National Football League wide receiver Willie Gault, as well as the corporations Merck and Walmart.
