    Chinese navy helicopter flies within 10 feet of Philippine patrol plane over disputed shoal

    A Chinese navy helicopter flew within 10 feet (3 meters) of a Philippine patrol plane on Tuesday in a disputed area of the South China Sea, prompting the Filipino pilot to warn by radio: “You are flying too close, you are very dangerous.”

    The Chinese helicopter was attempting to force a Cessna Caravan turboprop plane belonging to the Philippine Bureau of Fisheries and Aquatic Resources out of what China claims is its airspace over the hotly disputed Scarborough Shoal off the northwestern Philippines.

    An Associated Press journalist and other invited foreign media on the plane witnessed the tense 30-minute standoff as the Philippine plane pressed on with its low-altitude patrol around Scarborough with the Chinese navy helicopter hovering close above it or flying to its left in cloudy weather.

    “You are flying too close, you are very dangerous and endangering the lives of our crew and passengers,” the Philippine pilot told the Chinese navy helicopter by radio at one point. “Keep away and distance your aircraft from us, you are violating the safety standard set by FAA and ICAO.”

    The pilot was referring to the standard distance between aircraft required by the U.S. Federal Aviation Administration and the International Civil Aviation Organization to prevent air disasters.

    There was no sign that the Philippine plane had to alter its planned path and altitude to avoid a collision.

    The Philippine Coast Guard and the Bureau of Fisheries said in a statement that they remain “committed to asserting our sovereignty, sovereign rights and maritime jurisdiction in the West Philippine Sea, despite the aggressive and escalatory actions of China.”

    They referred to the Philippine name for the stretch of waters in the South China Sea closer to the Philippines’ western coast.

    The Chinese military, referring to Scarborough Shoal by its Chinese name, said the plane had “illegally entered the airspace of China’s Huangyan Island without the Chinese government’s permission.”

    The Chinese Southern Theater Command organized naval and air forces to track and warn the plane away, Senior Col. Tian Junli, spokesperson for the command, said in a written statement posted online.

    The Philippines “confused right and wrong and spread false narratives,” the statement said.

    Tuesday’s encounter, which is expected to be protested by the Philippine government, is the latest flashpoint in a decades-long territorial standoff in one of the world’s busiest trade routes, which involves China, the Philippines, Vietnam, Malaysia, Brunei and Taiwan .

    Confrontations on the high seas have spiked between Chinese and Philippine coast guards in the last two years at Scarborough and Second Thomas Shoal, where a grounded Philippine navy ship has served as a military territorial outpost since 1999 but has since been closely surrounded by Chinese coast guard, navy and other ships.

    China deployed its naval force around Scarborough after a tense standoff with Philippine ships in 2012.

    The following year, the Philippines brought its disputes with China to international arbitration. A 2016 decision by a United Nations-backed arbitration panel invalidated China’s expansive claim in the South China Sea based on the U.N. Convention on the Law of the Sea.

    China, a signatory to the UNCLOS like the Philippines, refused to participate in the arbitration, rejected its outcome and continues to defy it.

    Faced by China’s military might, the Philippines under President Ferdinand Marcos Jr. has resorted to a shame campaign — embedding Philippine and foreign journalists in its sea and air patrols in a bid to expose Beijing’s increasingly assertive actions.

    The Philippines has also been strengthening its security alliances with the United States, Japan, Australian, France, Canada, the European Union and other Western countries to shore up its external defense.

    The United States says it’s obligated to defend the Philippines, its oldest treaty ally in Asia, if Filipino forces, ships and aircraft come under an armed attack, including in the South China Sea. China has warned the U.S. and its allies not to meddle in what it calls a purely Asian dispute.

    Chinese companies are shoring up their U.S.-based production and warehouses to evade the Trump administration’s crackdown on Communist Party of China (CCP) imports. 

    Fashion brand Temu is pushing its locally made products after the Trump administration put an end to a lucrative trade loophole that allowed Chinese fast fashion and low-cost goods to make their way into the U.S. and evade tax enforcement. 

    Temu is now promoting items stored in its U.S. warehouses under its “lightning deals” section and a “local warehouse” section on its website. 

    The Trump administration ended an exemption known as “de minimus,” which allowed goods valued less than $800 to enter the U.S. without paying duties.

    The de minimus rule helped Temu offer the U.S. suspiciously low-cost goods like $5 sneakers and $6 knockoff AirPods. 

    Singapore-based, China-founded fast fashion brand Shein has adopted a similar strategy, and it now has a growing U.S.-based workforce of 1,500 and is increasingly relying on warehouses in California and Indiana. 

    This month, Shein opened a Seattle hub for U.S. fulfillment and logistics operations as it seeks to localize deliveries.

    Meanwhile, Chinese quartz company Sunfat Marble and Granite put out a pro-Trump news release promising “intentions for a historic investment into America, with a commitment to create tens of thousand (sic) new American jobs, including construction of new manufacturing facilities across the heartland of the U.S., with an investment totaling $250 million.”

    “With President Trump in power, we’re more excited than ever to commit to the United States,” the company said in a release seen by Fox Business.

    “We understand Americans are skeptical of Chinese companies and concerned about foreign investment. It’s why we are also announcing a commitment to only hire American workers. There will be no H1-B visas. There will be no undercutting of American wages.”

    On Monday, Trump slapped 25% tariffs on all steel and aluminum imports, which came one week after Trump imposed a 10% tariff on all Chinese goods.

    CATL, the world’s top battery maker, has said it will consider building a U.S. plant if Trump opens the door to Chinese investment in the American electric vehicle supply chain. 

    “Originally, when we wanted to invest in the U.S., the U.S. government said no,” CATL founder Robin Zeng told Reuters. “For me, I’m really open-minded.” 

    China’s EV and battery firms are heavily subsidized by the CCP and face some of the steepest trade restrictions due to competition and national security concerns. Chinese EV imports are slapped with a 100% tariff, an effective ban.

    It’s not clear how many of the Chinese-based efforts to build U.S.-based supply chains will be successful, and they pose a risk of furthering CCP intellectual theft by allowing such companies to do business here. 

    This week, Rep. Abe Hamadeh, R-Ariz., wrote a letter to the CEO of a Chinese battery company that operates in California, Stored Power Tech Technology Systems Inc., demanding to know more about its rumored links to China Shipbuilding Corp. (Fangfen), an entity controlled by the CCP. The company touts its ties to Fangfen on its LinkedIn page.

    “If these allegations are confirmed, the relationship would blatantly violate U.S. law,” said Hamadeh. “The notion of a Chinese state-controlled enterprise penetrating the U.S. battery industry, especially with potential ties to the Chinese military, is a grave threat.”

    China responds with tariffs on US goods after Trump’s tariffs on Chinese imports

    China imposed tariffs on some U.S. imports early Tuesday morning in response to new tariffs President Donald Trump placed on Chinese goods beginning at midnight.

    Trump had signed an executive order authorizing a 10% additional tariff on imports from China. 

    The order also included a 25% additional tariff on imports from Canada and Mexico, and an additional 10% tax on energy imported from Canada, including oil, natural gas and electricity. The president has since agreed to a 30-day pause on the tariffs on Mexico and Canada.

    The additional 10% tariff on all Chinese imports into the U.S. went into effect on Tuesday after Trump warned Beijing it was not doing enough to stop fentanyl from being trafficked into the country. Trump plans to speak to Chinese President Xi Jinping later in the week, according to the White House.

    China’s Finance Ministry said shortly after the tariff started that it would impose a tariff of 15% for coal and liquefied natural gas and 10% for crude oil, agricultural equipment and large-engine cars imported from the U.S.

    An anti-monopoly investigation into Alphabet Inc’s Google was also announced, while including both PVH Corp., the holding company for Calvin Klein and other brands, and U.S. biotechnology company Illumina on its “unreliable entities list.”

    Additionally, China’s Commerce Ministry and its Customs Administration revealed it is imposing export controls on some rare earths and metals that are critical for high-tech gadgets and the clean energy transition.

    The new tariffs on U.S. goods will start on Feb. 10, according to the ministry.

    During Trump’s first term, he started a two-year trade war with China over its massive U.S. trade surplus, with each side imposing tariffs on hundreds of billions of dollars worth of goods, hurting global supply chains and damaging the world economy.

    Trump had warned he might continue to increase tariffs on China unless it blocked the flow of fentanyl into the U.S.

    “China hopefully is going to stop sending us fentanyl, and if they’re not, the tariffs are going to go substantially higher,” the president said Monday.

    China has said the flow of fentanyl is a U.S. problem and that it would challenge the tariffs at the World Trade Organization and look for other countermeasures, although it also left the door open for dialogue.

    How Trump’s tariffs closed the loophole used by Chinese retailers

    President Donald Trump’s new tariffs include a provision that suspends a key trade loophole that Chinese retailers like Shein and Temu have utilized to expand their access to U.S. consumers and has been criticized for allowing shipments of fentanyl precursors to enter the country.

    Trump’s executive orders imposing tariffs on China, Canada and Mexico effective Tuesday included language suspending the so-called “de minimis” loophole that allows shipments of imports valued at less than $800 to enter the U.S. without duties and taxes from those three countries. Trump on Monday paused tariffs on Mexico for one month after the country’s president, Claudia Sheinbaum, agreed to send 10,000 troops to the U.S.-Mexico border.

    The de minimis rule reduces administrative burdens on low-cost imports. In 2015, the Obama administration lifted the waiver threshold from $200 to the current $800 – which resulted in shipments claiming the de minimis waiver increasing by over 600% in the last decade to more than 1 billion items in fiscal year 2023, according to data from U.S. Customs and Border Protection (CBP).

    Chinese e-commerce giants Shein and Temu have seen rapid growth in the U.S. market through de minimis shipments of fast fashion, toys and other consumer goods to cost-conscious consumers. A report by the Congressional Research Service (CRS) noted that Shein and Temu combined to comprise about 17% of the U.S. discount market as of November 2023.

    The rise of Shein and Temu has contributed to an increase in U.S. retail store closures, according to a report by Coresight Research. It estimated that about 15,000 closures will occur in 2025 after there were 7,323 closures in 2024 – which was the highest number of closures since 2020, when nearly 10,000 stores shut down.

    The reduced scrutiny of de minimis shipments has also been linked to the smuggling of fentanyl, a synthetic opioid that killed nearly 75,000 people in 2023.

    An investigation by Reuters reporters last year found that they were able to use the de minimis loophole to import the main precursor chemicals for at least 3 million fentanyl tablets due to overseas shippers intentionally mislabeling the packages as electronics.

    “The flow of illicit drugs like fentanyl to the United States through both illicit distribution networks and international mail – due, in the case of the latter, to the existing administrative exemption from duty and taxes, also known as de minimis,” Trump’s tariff order on Canada said.

    Issues with the de minimis loophole have drawn the attention of Congress and previous administrations. 

    Earlier this month, the outgoing Biden administration proposed a rule that would eliminate de minimis treatment of goods from China that are subject to tariffs, while also requiring shippers to include 10-digit tariff codes on packages to make it easier for customs officials to identify and interdict illicit goods.

    Lawmakers have also raised concerns that the loophole allowed Chinese companies to ship products using the de minimis loophole and evade scrutiny under the Uyghur Forced Labor Protection Act (UFLPA). That law aims to prevent goods made by the forced labor of Uyghurs, a Muslim minority persecuted by the Chinese Communist Party, from entering the U.S. market.
