Federal court blocks Trump admin from sending detained Venezuelan immigrants to Guantánamo Bay

A federal court on Sunday issued a temporary restraining order blocking the Trump administration from sending three Venezuelan immigrants held in New Mexico to the Guantánamo Bay, Cuba, detention camp as part of the president’s efforts to remove illegal immigrants from the U.S.

Lawyers for the trio said in a legal filing that the detainees “fit the profile of those the administration has prioritized for detention in Guantánamo, i.e. Venezuelan men detained in the El Paso area with (false) charges of connections with the Tren de Aragua gang.”

In the filing, the lawyers asked a U.S. District Court in New Mexico for a temporary restraining order to block the administration from flying them to the U.S. military base. The lawyers noted that “the mere uncertainty the government has created surrounding the availability of legal process and counsel access is sufficient to authorize the modest injunction.”

Judge Kenneth J. Gonzales granted the temporary restraining order, according to attorney Jessica Vosburgh, who represents the three men.

“It’s short term. This will get revisited and further fleshed out in the weeks to come,” Vosburgh told The Associated Press.

The filing came as part of a lawsuit on behalf of the three men filed by the Center for Constitutional Rights, the American Civil Liberties Union of New Mexico and Las Americas Immigrant Advisory Center.

Last week, Homeland Security Secretary Kristi Noem and White House press secretary Karoline Leavitt separately said that flights carrying detained illegal immigrants had been sent to Guantánamo.

Immigrant rights groups sent a letter on Friday demanding access to people who are now being held at the U.S. naval station, arguing that the base should not be used as a “legal black hole.” Guantánamo has been criticized around the world for its inhumane abuse and torture of detainees, including interrogation tactics.

The immigrants are being held in the Guantánamo detention camp that was set up for detainees in the aftermath of 9/11. The immigrants are separated from the 15 detainees who were already there, including planners in the 2001 terrorist attack.

Trump has promised to expand the detention camp to hold up to 30,000 “criminal illegal aliens.”

Leavitt said Wednesday that more than 8,000 immigrants have been arrested since Jan. 20 as part of Trump’s plan to detain and deport immigrants in the country illegally, although hundreds of those arrested have since been released back into the U.S.

Pritzker trolls Trump by ‘renaming’ Lake Michigan as ‘Lake Illinois,’ joking he’d annex Green Bay

Illinois Gov. J.B. Pritzker has taken a satirical jab at President Donald Trump’s effort to rename the Gulf of Mexico and annex Greenland.

A straight-faced Pritzker released a choreographed video on Friday, with fake camera shutter clicks going off in the background, where he asserts that he is renaming Lake Michigan to “Lake Illinois,” poking fun at Trump’s recent executive order where he changed the Gulf of Mexico to Gulf of America.

“The world’s finest geographers, experts who study the Earth’s natural environment, have concluded a decades-long council and determined that a great lake deserves to be named after a great state,” Pritzker said.

“So today, I’m issuing a proclamation declaring that hereinafter, Lake Michigan shall be known as Lake Illinois. The proclamation has been forwarded to Google to ensure the world’s maps reflect this momentous change.”

Trump signed Executive Order 14172 on his first day back in office which changed the name of the ocean basin. The order also renamed the highest peak in North America to “Mount McKinley,” reversing the 2015 decision to call it by its centuries-old name Denali.

Google has said it will make Trump’s changes once the Department of the Interior updates the Geographic Names Information System. As of today, Google Maps still refers to it as the Gulf of Mexico.

In the video, Pritzker then switches his attention to Green Bay, a Wisconsin city near Lake Michigan. And just like how Trump vowed to take over Greenland from Denmark, Pritzker pledged to snap up Green Bay from The Badger State.

“In addition, the recent announcement that to protect the homeland, the United States will be purchasing Greenland… Illinois will now be annexing Green Bay to protect itself against enemies, foreign and domestic,” Pritzker said.

“I’ve also instructed my team to work diligently to prepare for an important announcement next week regarding the Mississippi River.”

“God bless America and bear down,” Pritzker said, a nod to Wisconsin’s Green Bay Packers, one of Chicago Bears’ biggest rivals.

The video comes on the heels of a Justice Department lawsuit filed against the state of Illinois and the city of Chicago for allegedly interfering with federal immigration enforcement with its sanctuary polices.

The lawsuit claims that several state and local laws are designed to interfere with the federal government’s enforcement of federal immigration law in violation of the Supremacy Clause of the United States Constitution.

Pritzker and Trump have also clashed over Trump’s executive order to end birthright citizenship, with Pritzker declaring the move unconstitutional.

Trump’s order, “Protecting the Meaning and Value of American Citizenship,” asserts that the 14th Amendment of the Constitution does not automatically confer American citizenship to individuals who are born within the United States.

They also feuded during Trump’s first term in office when Pritzker claimed the state only recovered a quarter of its requested personal protective equipment from the federal government.

Over a dozen Venezuelan criminal illegal migrants sent to Guantánamo Bay

More than a dozen Venezuelan criminal illegal migrants are on their way to the U.S.’ most secure prison — the Guantánamo Bay Detention Camp (GITMO) in Cuba — some of whom are members of the violent Venezuelan gang Tren de Aragua (TdA), according to Department of Homeland Security (DHS) sources.

TdA is an international criminal group that has been terrorizing U.S. communities from New York to Colorado. As one of his first actions, President Donald Trump issued an executive order on Jan. 20 instructing the State Department and other government agencies to move to designate TdA as a “foreign terrorist organization.”

Fox News learned that along with TdA gang members, the 13 Venezuelans being flown to GITMO include a murder suspect and a man who claims to have escaped from a Venezuelan prison.

The men are expected to be held at the detention center that is being expanded to house tens of thousands of criminal immigrants.

The DHS said the immigrants on the plane on Thursday are “highly dangerous” people who were in the U.S. illegally.

Along with a murder suspect and a prison escapee, the others in the group being taken to GITMO include those accused of robbery, intent to commit homicide, weapons trafficking, robbery and assault.

Earlier on Thursday, 10 high-threat migrants arrived at Guantánamo Bay, the Department of Defense (DOD) confirmed.

The DOD said migrant criminals are being housed in vacant detention facilities. The DOD said that is only a temporary arrangement being made to “ensure the safe and secure detention of these individuals until they can be transported to their country of origin or other appropriate destination.”

The DHS has clarified that the Guantánamo Bay prison will only be used to house “the worst of the worst” criminals.”

Late last month, Trump announced that he instructed the DOD to prepare Guantánamo Bay to house 30,000 “criminal illegal aliens.”

He said there are 30,000 beds at Guantánamo Bay to house the detainees who pose a threat to the American public, adding that putting them there will ensure they do not come back to the U.S.

The Department of Defense (DOD) confirmed the arrival of the first 10 “high threat” illegal migrant criminals to the U.S.’s most secure prison – the Guantánamo Bay Detention Camp – in Cuba, all of whom are members of the violent Venezuelan criminal group Tren de Aragua (TdA).

TdA is an international criminal group that has been terrorizing U.S. communities from New York City to Colorado. As one of his first actions, President Donald Trump issued an executive order on Jan. 20 instructing the State Department and other government agencies to move to designate TdA as a “foreign terrorist organization.”

On Thursday, ICE and other federal law enforcement agencies conducted a series of raids in Aurora, Colorado, resulting in the arrest of over 100 TdA members.

The 10 high-threat migrants arrived at Guantánamo Bay on Thursday, the DOD confirmed in a statement. The Department of Homeland Security (DHS) also confirmed the migrants’ arrival and stated that all 10 are members of Tren de Aragua.

The DOD stated that these migrant criminals are being housed in vacant detention facilities. Commenting on the arrests of the over 100 TdA members on Wednesday, Joseph Humire, executive director of the Center for a Secure Free Society and an expert on TdA, told Fox News Digital that Trump’s latest moves are “tremendously significant” that shows that there is a “new attitude” against TdA in the U.S.

“That’s what’s needed to be able to dismantle them and eventually deport them from the United States,” he said. “This is a foreign terrorist organization that has been spreading throughout the United States for the last couple of years and doing it so very rapidly, so I think the impetus is on the United States to use all the elements of our national security to be able to dismantle them from within.”

Mexico will not allow the U.S. government to send Mexican migrants to the Guantánamo Bay, Cuba, detention camp, Mexico’s foreign minister said on Tuesday.

Foreign Minister Juan Ramon de la Fuente said Mexico would rather directly receive the migrants.

The Mexican government sent a diplomatic note to the U.S. embassy in Mexico to explain its position.

This comes after White House press secretary Karoline Leavitt told reporters Tuesday that the Trump administration has begun flying detained illegal migrants from the U.S. to Guantánamo Bay, although she did not specify the nationalities of the people on those flights.

“I can also confirm that today the first flights from the United States to Guantánamo Bay with illegal migrants are underway,” Leavitt said.

“And so President Trump, Pete Hegseth and Kristi Noem are already delivering on this promise to utilize that capacity at Gitmo for illegal criminals who have broken our nation’s immigration laws and then have further committed heinous crimes against lawful American citizens here at home,” she continued.

One flight from Fort Bliss to Guantánamo Bay has roughly a dozen migrants on board, according to the Pentagon. An additional flight left the U.S. on Monday.

Last week, Cuban President Miguel Diaz-Canel called Trump’s effort to send 30,000 migrants to Guantánamo an “act of brutality.”

“In an act of brutality, the new US government announces the imprisonment at the Guantánamo Naval Base, located in illegally occupied territory [of Cuba], of thousands of migrants that it forcibly expels, and will place them next to the well-known prisons of torture and illegal detention,” he said in a translated post on X.

US begins flying migrants to Guantanamo Bay

The Trump administration has begun flying detained illegal migrants from the U.S. to Guantanamo Bay in Cuba, White House Press Secretary Karoline Leavitt told reporters Tuesday.

The move comes just days after President Donald Trump announced that he would instruct the Pentagon to prepare the facility to hold around 30,000 “criminal illegal aliens” at the U.S. military base.

“I can also confirm that today the first flights from the United States to Guantanamo Bay with illegal migrants are underway,” Leavitt said.

“And so President Trump, Pete Hegseth and Kristi Noem are already delivering on this promise to utilize that capacity at Gitmo for illegal criminals who have broken our nation’s immigration laws and then have further committed heinous crimes against lawful American citizens here at home.”

Leavitt said that El Salvador has agreed to the repatriation of its own citizens as well as also “illegal criminals from other nations” who will then be sent to their prisons.

“Venezuela as well has agreed to repatriation flights and Colombia also agreed to cooperate with the repatriation of illegal Colombian nationals that we have found in the interior of our country.”

The Wall Street Journal reported on Tuesday that one flight from Fort Bliss to Guantanamo has roughly a dozen migrants on board, the publication reports, citing people familiar with the matter. An additional flight left the U.S. on Monday, the publication reports, citing one of those people.

As of today, the facility is understood to have enough beds to cater to around 120 migrants. Homeland Security Secretary Kristi Noem told Fox News’ Will Cain on the “Will Cain Show” last week that Guantanamo Bay is already being used to house illegal immigrants, particularly the worst of the worst.

Noem said her department will make sure resources are placed there to ensure there is enough space to get criminal illegal aliens out of the U.S.

Trump last week signed a presidential memorandum last week to begin the process of making 30,000 beds available at Guantanamo to house migrants who pose a threat to the American public, adding that putting them there will ensure they do not come back.

“Some of them are so bad, we don’t even trust their countries to hold them because we don’t want them coming back,” Trump said. “We’re going to send them to Guantanamo.”

He added, “It’s a tough place to get out of.”

The president said the move will bring the U.S. one step closer to “eradicating the scourge” of migrant crime in communities, once and for all.

The migrant facility at the base is separate from the high-security U.S. prison for foreign terrorism suspects – which has been used occasionally for decades, including to hold Haitians and Cubans picked up at sea.

The Trump administration has not said how much it would cost to expand Guantanamo, which was established in 2002 to detain foreign militants in the wake of the Sept. 11, 2001, attacks on the United States.

He also called on Congress to provide full funding for the complete and total restoration of U.S. borders and financial support to remove record numbers of illegal aliens.

President Donald Trump announced Wednesday that he would sign an executive order for the Pentagon to prepare Guantanamo Bay to detain 30,000 “criminal illegal aliens.”
