    Trump admin aims for killing blow to independence of ‘Deep State’ agencies

    President Donald Trump’s Department of Justice is seeking to overturn a landmark Supreme Court case in an effort to give the president greater control over independent three-letter agencies.

    In a move that could allow Trump to more easily fire officials who refuse to implement his policies, the acting U.S. solicitor general sent Illinois Democratic Sen. Dick Durbin a letter on Wednesday, notifying him of the Justice Department’s plans to ask the Supreme Court to overturn a key precedent that limits the president’s power to remove independent agency members. 

    The letter, penned by Acting Solicitor General Sarah Harris, says the DOJ has determined “that certain for-cause removal provisions” that apply to certain administrative agency members are unconstitutional, and the department would “no longer defend their constitutionality.”

    Humphrey’s Executor v. United States, the case in question, is a 1935 Supreme Court case that narrowed the president’s constitutional power to remove agents of the executive branch.

    Harris cited a previous case, Myers v. United States, which held that the Constitution granted the president sole power to remove executive branch officials. 

    “The exception recognized in Humphrey’s Executor thus does not fit the principal officers who head the regulatory commissions noted above,” Harris wrote in the letter. 

    “To the extent that Humphrey’s Executor requires otherwise, the Department intends to urge the Supreme Court to overrule that decision, which prevents the President from adequately supervising principal officers in the Executive Branch who execute the laws on the President’s behalf, and which has already been severely eroded by recent Supreme Court decisions,” Harris continued. 

    Durbin called the letter a “striking reversal of the Justice Department’s longstanding position under Republican and Democratic presidents alike,” in a statement to Fox News Digital. He added that the request is “not surprising from an administration that is only looking out for wealthy special interests – not the American people.”

    However, conservative legal theorists supported the Trump administration’s move, arguing that overturning Humphrey’s Executor would move the federal government closer to the original intent of the Constitution’s framers. Trump notably posed his presidential campaign against former President Joe Biden as a contest between the “deep state” and democracy, saying at the time, “Either we have a deep state or we have a democracy. We’re going to have one or the other. And we’re right at the tipping point.”

    “Congress makes the laws, it’s the president’s duty to carry out and enforce those laws under the unitary executive theory,” Hans von Spakovsky, Senior Legal Fellow at the Heritage Foundation, told Fox News Digital. “That means that the president, since he’s the head of the executive branch, has complete control over the executive branch, and that includes the hiring and firing of everyone in the executive branch, most particularly, and most importantly, the heads of all the different offices and departments within the executive branch.”

    Von Spakovsky says the exception carved out by the Court in Humphrey’s Executor “does not apply to these federal agencies.” In her letter, Harris specifically mentioned the Federal Trade Commission (FTC), the National Labor Relations Board (NLRB) and the Consumer Product Safety Commission (CPSC). 

    Earlier this month, a former NLRB member sued Trump over her termination, arguing that federal law protects her from being arbitrarily dismissed. The Trump administration has also become the target of various other lawsuits involving federal employee dismissals.

    “My take on what’s going on with the Trump agenda right now is that they’re itching to get up to the higher federal court level, including the Supreme Court, to press just this kind of question,” Ronald Pestritto, Graduate Dean and Professor of Politics at Hillsdale College, told Fox News Digital. 

    Pestritto says some of the administration’s actions “contradict existing civil service law, existing protections, for example, against removing the NLRB commissioners.”

    “And so, clearly, they know they’re going to lose a lot of that at the lower court level. And they want to push them up into the Supreme Court, because they think they might get a reconsideration of it,” Pestritto said. 

    Von Spakovsky stated that independent agencies are “unaccountable” as a result of Humphrey’s Executor, saying “you make them accountable to voters by putting them back where they belong, which is under the authority of the president.”

    Trump’s lawyers are likely to lose in the lower court, Pestritto says, where he expects judges to apply the Supreme Court’s precedent in their own decisions. But even so, the Trump administration can appeal higher and higher to attempt to get Supreme Court review, where Humphrey’s Executor could be overturned. 

    [Democrats] are going to win injunctions very often, first of all, because they know it’s easy to judge-shop for sympathetic district judges. And number two, the district judges are basically going to go by the existing Supreme Court precedent,” Pestritto said. “And so the real tale of the tape will be when these initial rulings get appealed up the appellate ladder and ultimately up to the Supreme Court, which certainly has many justices who I think understand Article II of the Constitution properly and may be open to a reconsideration of Humphrey’s.”

    The Senate Republican campaign committee is touting that it is off to a strong fundraising start as it aims to defend and expand its majority in the chamber in the 2026 midterm elections.

    The National Republican Senatorial Committee (NRSC) announced on Monday that it raked in a record $8.5 million in January, which the committee says is its best ever off-year January haul.

    “To deliver on the promises President Trump made to the American people, we must protect and grow our Republican Senate Majority,” South Carolina Sen. Tim Scott, the new NRSC chair, said in a statement.

    Scott teased that “the NRSC’s record-breaking January is just the beginning. We will work tirelessly to ensure Republicans have the resources and operations needed to win in battleground states across the Senate map.”

    However, in a memo sent to Senate Republican chiefs of staff, NRSC Executive Director Jennifer DeCasper noted that the committee will “enter this cycle with nearly $24 million in debt and unpaid bills from last cycle and limited cash on hand.”

    The NRSC ended 2024 with $2.7 million in its coffers.

    The rival Democratic Senatorial Campaign Committee has yet to announce its January fundraising.

    Republicans won control of the Senate in November’s elections by flipping an open seat in West Virginia, and ousting Democratic incumbents in Montana, Ohio and Pennsylvania. The GOP currently holds a 53-47 majority in the Senate.

    The GOP will target an open Democrat-held seat in battleground Michigan, where Sen. Gary Peters announced last week that he would not seek re-election in 2026. They will also target first-term Sen. Jon Ossoff in battleground Georgia and longtime Sen. Jeanne Shaheen in swing state New Hampshire.

    However, Democrats plan to go on offense in blue-leaning Maine, where GOP Sen. Susan Collins is up for re-election, as well as in battleground North Carolina, where Republican Sen. Thom Tillis is also up in 2026.

    The Democratic National Committee (DNC) on Saturday elected Minnesota party leader Ken Martin as its next national chair, in the wake of major setbacks up and down the ballot in the 2024 elections.

    The election of Martin is the party’s first formal step to try and rebound from the November elections, in which President Donald Trump recaptured the White House, and Republicans flipped the Senate, held on to their fragile majority in the House and made major gains with working-class, minority and younger voters.

    “We have one team, one team, the Democratic Party,” Martin said following his victory. “The fight is for our values. The fight is for working people. The fight right now is against Donald Trump and the billionaires who bought this country.”

    Martin, over the past eight years, has served as a DNC vice chair and has led the association of state Democratic Party chairs.

    He topped Wisconsin Democratic Party chair Ben Wikler by over 100 votes among the 428 DNC members who cast ballots as they gathered for the party’s annual winter meeting, which this year was held at National Harbor in Maryland, just outside of Washington, D.C.

    Martin O’Malley, the former two-term Maryland governor and 2016 Democratic presidential candidate who served as commissioner of the Social Security Administration during former President Biden’s last year in office, was a distant third in the voting.

    Among the longshot candidates were Faiz Shakir, who ran the 2020 Democratic presidential campaign of Sen. Bernie Sanders of Vermont, and Marianne Williamson, who ran unsuccessfully for the 2020 and 2024 Democratic presidential nominations. Williamson endorsed Martin on Saturday, ahead of the vote.

    The eight candidates in the race were vying to succeed DNC Chair Jaime Harrison, who decided against seeking a second straight four-year term steering the national party committee.

    With no clear leader in the party, the next DNC chair could become the de facto face of Democrats from coast to coast and will make major decisions on messaging, strategy, infrastructure and where to spend millions in political contributions.

    “It’s an important opportunity for us to not only refocus the party and what we present to voters, but also an opportunity for us to look at how we internally govern ourselves,” longtime New Hampshire Democratic Party Chair Ray Buckley told Fox News Digital.

    Buckley, a former DNC vice chair who backed Martin, said he’s “very excited about the potential of great reform within the party.” He emphasized that he hoped for “significantly more support for the state parties. That’s going to be a critical step towards our return to majority status.”

    In his victory speech, Martin stressed unity and that the party needed “to rebuild our coalition.”

    “We need to go on offense,” Martin said. “We’re going to go out there and take this fight to Donald Trump and the Republicans.”

    Former Vice President Kamala Harris, who succeeded President Biden last July as the party’s 2024 standard-bearer, spoke with Martin, Wikler and O’Malley in the days ahead of Saturday’s election, Fox News confirmed. But Harris stayed neutral in the vote for party chair.

    In a video message to the audience as the vote for chair was being tabulated, Harris said that the DNC has some “hard work ahead.”

    But she pledged to be with the party “every step of the way,” which could be a signal of her future political ambitions.

    The debate during the three-month DNC campaign sprint mostly focused on the logistics of modern political campaigns, such as media strategy and messaging, fundraising and grassroots organizing and get-out-the-vote efforts. On those nuts-and-bolts issues, the candidates were mostly in agreement that changes are needed to win back blue-collar voters who now support Republicans.

    But the final forum included a heavy focus on race and diversity, equity and inclusion (DEI) programs, issues that appeared to hurt Democrats at the ballot box in November.

    The forum, moderated and carried live on MSNBC and held at Georgetown University in Washington, D.C., devolved into chaos early on as a wave of left-wing protesters repeatedly interrupted the primetime event, heckling over concerns of climate change and billionaires’ influence in America’s elections before they were forcibly removed by security.

    The chair election took place as a new national poll spelled more trouble for the Democrats.

    Only 31% of respondents in a Quinnipiac University survey conducted over the past week had a favorable opinion of the Democratic Party, with 57% seeing the party in an unfavorable light.

    “This is the highest percentage of voters having an unfavorable opinion of the Democratic Party since the Quinnipiac University Poll began asking this question,” the survey’s release noted. 

    Meanwhile, 43% of those questioned had a favorable view of the GOP, with 45% holding an unfavorable opinion, which was the highest favorable opinion for the Republican Party ever in Quinnipiac polling.
