    A crypto pioneer was denied housing in ‘mecca’ of Democratic Party fundraisers. Now he alleges discrimination

    A San Francisco apartment co-op used to house ritzy Democrat campaign parties and its megadonors has found itself as the defendant in a new discrimination lawsuit filed by a cryptocurrency pioneer.

    Jesse Powell, the co-founder of crypto exchange Kraken, is suing the 2500 Steiner Street shareholder corporation over alleged discriminatory actions against his financial, criminal and potential political affiliations that led to the denial of his purchase of California Lt. Gov. Eleni Kounalakis’ unit.

    “I’m just frankly exhausted at dealing with this, exhausted from being discriminated against,” Powell told Fox News Digital on Friday. “And San Francisco should not be the place where that happens. In fact, San Francisco needs the crypto industry more than ever right now.” 

    “I think that the hypocrisy of the so-called progressive movement that somehow can’t tolerate ideas that disagree with their own, meanwhile claiming to be open to everything,” he added. “It’s just bizarre to me.”

    Powell filed the lawsuit last Wednesday – claiming he “tried everything to avoid” it – where it’s alleged that he and the unit seller inked a nearly $15.5 million deal for the sale of the unit in September and entered escrow before the co-op board learned of his identity and their “demeanor changed.”

    Powell holds protected status under California’s Fair Employment Housing Act (FEHA) and the Unruh Act, due to his source of income and criminal history. FBI agents had searched Powell’s Los Angeles home in July 2023 over hacking and cyberstalking allegations, but he was never charged with any crime in connection to the search and seizure.

    “The final attempt that I made was to send each shareholder a personal letter explaining why I think I would be a good neighbor, asking to have a conversation with them. And the response we got back from that was, ‘We consider the matter to be closed,’ from their attorney,” Powell explained. “And so that, to me, was the end of the road of trying to resolve this amicably. And I had no other choice but to file a lawsuit at that point.”

    In a co-op building, buyers invest in shares of a housing cooperative as opposed to owning a property. When Powell’s offer reached the shareholders for final approval, the lawsuit says the board “schemed to discriminate against Mr. Powell by refusing to approve the sale,” and “the Corporation never gave Mr. Powell a straight answer for its denial, instead offering only obfuscation and shifting pretexts for hindering.”

    This specific 12-unit property is colloquially known as “Susie’s Building,” named after businesswoman and longtime Democratic donor Susie Tompkins Buell.

    “Whether our political differences might have sort of tinged their opinion or willingness to have an open mind about those things, maybe. But, the building is packed with Democrats,” Powell noted. “It’s obviously known for [and] has a reputation of being this sort of mecca of Democratic Party fundraisers where the who’s who of the party go floor to floor collecting checks.”

    “I’m not a Democrat, but I’m not a Republican either. I vote the issues. I consider each candidate independently. I look at the public policy implications of things. And so, I just happen to be, I think, more aligned with sort of right-coded causes over the last four years as the Biden administration had attacked our industry,” the Kraken co-founder continued.

    When going through the shareholder approval process, Powell understood that an agreement between him and the sellers was not the end of the purchase. Bylaws required the sale to be submitted to the building’s non-selling shareholders.

    Powell’s application was initially denied in October, when no reason was reportedly listed for the denial. Upon pressing for an answer, the building’s property manager claimed there were “a number of concerns” deemed “unresolvable.”

    Days later, the lawsuit alleges, the 2500 Steiner Street board told Powell that the denial was a matter of finances, which his attorneys argued were “far from ‘unresolvable.’” He provided necessary documentation, and requested a meeting with the board as typical in co-op transactions, but “no such meeting happened” before the shareholders delivered their final decision in November.

    “The shareholders knew who the seller was all along. They received the entire package of materials, including the transfer agreement… They knowingly, to the lieutenant governor of California, were willing to block her from selling her unit that she’s been trying to sell, from my understanding, for over a year, quietly and off the market,” Powell said.

    “Obviously, she didn’t want coverage of this. And they sort of forced her into a position of now being in the media about this transaction. And so, you have to wonder if there’s some bad blood there – why is she getting out of the building? If she’s leaving San Francisco, why is she leaving San Francisco? That’s probably a larger question.”

    Representatives for the 2500 Steiner Street corporation did not return Fox News Digital’s request for comment.

    Lt. Gov. Kounalakis’ office also did not respond to Fox Digital’s request for comment.

    Though Powell has no formal attachment to the Democrat or Republican Parties, he did donate $1 million to President Donald Trump’s campaign in June and has recently “supported nationally popular conservative causes,” the lawsuit says. He co-founded Kraken in 2011 and stepped down as CEO in April 2023, but remains as chairman and a large shareholder.

    He argues that preventing this real estate deal is “very bad for San Francisco,” perpetuating a city housing supply shortage, keeping millions of dollars from entering the local economy and hindering other successful entrepreneurs from moving there.

    “This has far-reaching implications. It’s not just about this one unit in the city preventing somebody from moving from one city to another city… I think we need to look at the rules around co-ops, and maybe we need some new law that says you can’t discriminate against anybody for any reason other than financial qualifications when it comes to housing. No matter how much you like them, no matter how much you don’t like them, no matter whether you think they’re going to be a good neighbor or not. If they’re financially qualified, you got to let them in.”

    When asked why he has no desire to find another property, Powell replied that 2500 Steiner Street’s “amazing” views of the Golden Gate Bridge, Alcatraz Island and its location convinced him to move back to San Francisco after leaving for Los Angeles in 2018.

    “I guess I just sort of became emotionally attached to it. And me going to another unit doesn’t really solve the housing problem. It’s still one less unit that’s on the market,” he said. “I’m happy to live in a neighborhood with people with different ideas, happy to live in a building with people with different ideas… I take care of my neighbors and I want to make San Francisco a better place. And I don’t think ruffling a few feathers, people being uncomfortable, people not wanting to see me as they pass me in the lobby… is a reason to block somebody from having an apartment. I think it’s extremely selfish.”

    The Kraken co-founder isn’t interested in playing a part in the California exodus either, though people have suggested he move to places like Austin, Texas, or Miami, Florida. He stood firm in that he hopes to “make a difference” in his longtime home state “rather than flee.”

    A court date has been set for July 9 in California’s superior court to hear opening arguments of the case. Powell and his attorneys are asking the judge to move the unit sale forward and award declaratory relief for compensatory damages, punitive damages and legal fees and costs.

    “We may get to some sort of settlement before that happens. If this ultimately goes to trial, a jury will have to decide on whether there was unlawful discrimination or not,” Powell said. “There are a few avenues we can discuss in settlement if they’re interested in settlement. But, I’m really focused on just being able to move into that unit. And that’s really the most satisfying outcome to me.”

    “San Francisco’s obviously welcoming of a wide variety of people from all walks of life who have very different ideas about how to live and what their identities are. In fact, San Francisco is a sanctuary city… And so you would think that the people that live in this building, who were largely Democrats and donate to these causes of diversity and inclusion, would be open to somebody with a diverse job or a diverse opinion about politics or even cryptocurrency. As you know, the cryptocurrency industry has faced significant debanking. And so we are used to being discriminated against on the basis of our industry and the work that we do. And it feels like this is yet another example of being discriminated against on the basis of the work that I do.”

    “I think the city has a lot of work to do to bring back businesses, to revitalize downtown. And it’s not going to get very far if people like me continue to be discriminated against when they’re looking for housing to return to San Francisco,” he concluded.

    Zelenskyy ready ‘to do a deal’ with Trump on raw earth minerals and military assistance

    Ukrainian President Volodymyr Zelenskyy is preparing to meet with Vice President JD Vance at the Munich Security Conference later this week after confirming on Friday he is ready to “do a deal” with President Donald Trump.

    According to an interview with Reuters, Zelenskyy said he was ready to supply the U.S. with rare-earth minerals in exchange for Washington’s continued backing of its war effort.

    “If we are talking about a deal, then let’s do a deal, we are only for it,” Zelenskyy said.

    The Ukrainian president has made clear he is also open to engaging in peace talks with Russia to end the three-year-long war, though possible terms for securing a peace deal remain varied and unknown. 

    Though Zelenskyy has said he is looking for “guarantees” when it comes to future security assurances for the war-torn country.

    These security assurances will likely need to be more than a formal handshake paired with a signed document, as Russia has twice violated its last agreement with Ukraine, known as the 1994 Budapest Memorandum. 

    The deal saw Kyiv hand over its nuclear arsenal to Moscow for dismantlement in exchange for sovereignty and independence guarantees from Russia, the U.S. and the U.K. However, the agreement did not stop Russia from invading Ukraine twice under Russian President Vladimir Putin.  

    Zelenskyy apparently first floated the idea of trading Ukraine’s mineral resources – roughly 20% of which are located in now Russian controlled territory, including half of the rare-earth variety – under his “victory plan” first presented to Western allies last fall, reported Reuters. 

    Rare-earth materials are used in the production of consumer electronics and electric engines. Zelenskyy has warned that Russia could give these resources to its allies like North Korea and Iran – the latter of which the U.S. just last week began to even more heavily sanction.

    “We need to stop Putin and protect what we have – a very rich Dnipro region, central Ukraine,” Zelenskyy reportedly said.

    While Trump will not attend the Munich Security Conference, Zelenskyy will lead the Ukrainian delegation there and is reportedly expected to meet with Vance and special envoy to Ukraine and Russia, retired Lt. Gen. Keith Kellogg.

    Trump told reporters last week that Zelenskyy may travel to D.C. in the week following the security conference, which runs Feb. 14-16, at which time both presidents will once again meet to discuss the war. 

    “I’d like to see that war end,” Trump told reporters last week. “We’re looking to do a deal with Ukraine where they’re going to secure what we’re giving them with their rare earth and other things.”

    Russia’s war effort in eastern Ukraine continues to rage, and Moscow on Friday claimed it had captured the mining town of Toretsk in the Donetsk region despite Ukraine’s months-long attempts to stop Russian advances.

    As Moscow continues to see incremental gains in eastern Ukraine, Kyiv is also pushing forward with its own attempts to seize Russian territory, which security experts have told Fox News Digital could be an attempt to give it better bargaining leverage come the time for ceasefire talks with Moscow.

    Zelenskyy also said on Friday that Ukraine had opened a new offensive in Russia’s Kursk region, where Kyiv first began its incursion in August 2024.

    “In the areas of the Kursk operation, new assaults have taken place,” Zelenskyy said during his nightly address. “Russia has once again deployed North Korean soldiers alongside its troops.”

    It is unclear if North Korea has sent more troops to Russia after its initial deployment of as many as 12,000 men last October, though South Korean intelligence has warned Pyongyang is planning to do so.

    Zelenskyy Sunday night said Ukrainian troops in Kursk “demonstrate highly effective enemy destruction,” though he did not detail any casualty rates among Russian or North Korean troops.

    Nonprofit calling on Trump HHS, Robert F. Kennedy Jr. to reform ‘failed’ National Human Trafficking Hotline

    A group of anti-human trafficking advocates called “Safe House Project” is urging the Trump administration and Health and Human Services (HHS) Secretary nominee Robert F. Kennedy Jr. to reform the National Human Trafficking Hotline.

    The hotline, which is run by HHS, was started in 2007 to provide 24/7 help for victims of human trafficking. 

    According to Safe House Project, which offers victims a range of services, including a network of shelters, the hotline has “lost all credibility” and simply does not accomplish the goal of ending human trafficking.

    After Kennedy cleared a committee vote on Tuesday, bringing him one step closer to confirmation, the nonprofit released a statement celebrating the step, saying that “our nation is in dire need of leadership that will restore it [the hotline] to fulfill its purpose of identifying victims of trafficking, supporting victims escaping from their traffickers, and helping bring swift justice to those who abuse and victimize desperate and vulnerable populations.”

    In line with the Department of Government Efficiency’s mission to slash government waste, Safe House Project says HHS can reform the hotline to conserve its tax-dollar funding and save more lives at the same time.

    “The American taxpayers funded the National Human trafficking hotline, and the reality is it has failed,” Safe House Project CEO Kristi Wells told Fox News Digital.

    Wells claimed that people who call the hotline often have to wait upwards of 45 minutes, resulting in many people hanging up before even reporting a human trafficking incident. She also said that in many instances, hotline staff fail to return calls or to share tips with law enforcement.

    If he is confirmed by the Senate, Wells said Kennedy will have a “phenomenal opportunity” to save thousands of lives by moving quickly to increase the efficiency of the hotline.

    The National Human Trafficking Hotline, again, has the potential to save thousands, if not hundreds of thousands of lives,” she continued. “And so, [since] the Department of Health and Human Services is the one that oversees the effectiveness of the hotline, it’s really important that the current administration prioritizes and really holds the current hotline accountable and making sure that the services are operating the way that they need to be operating.”

    In place of the current hotline, Wells is urging HHS to leverage modern technology – such as cellphone apps and AI – to create a new system that is “fast, actionable and easy to use.”

    After conducting extensive research with law enforcement entities and related NGOs, Wells said she believes a new system could be created using modern technology that would make the tax dollars being spent by the government on this go much further and accomplish more.

    When you’re leveraging technology, you are really creating efficiencies of scale and really increasing scale,” she said. “And so, I don’t believe that this is a solution that would cost the government more money. I think it would allow them to use the dollars that are currently being spent on a national hotline more effectively and see more effective results.”

    Wells said the Trump administration “has already shown an encouraging willingness to tackle human trafficking,” but noted, “We want to do our part to make sure that this is a top priority for them and make sure that correct actions are taken to bring victims out of the shadows, to increase reporting and to increase law enforcement and prosecution of traffickers and buyers.”

    “Human trafficking is happening all around us and we as community members have the opportunity to identify and respond to human trafficking and a new tool is really vital to us making sure that that happens,” she continued. “Whenever we have proper reporting mechanisms and we are ‘seeing something and saying something,’ then this idea that human trafficking is undercover and goes undetected is no longer the reality.”

    “The reality is we’ll be able to see it more and when we start seeing it more, we’re able to empower our lawmakers with more effective data to create more effective policies. And so, I am excited about the trajectory that a more robust reporting mechanism can bring to the objective of eradicating trafficking in America.”

    The rising attacks on Microsoft Teams users

    Cybercriminals are increasingly targeting Microsoft Teams users with sophisticated attack methods. One such technique involves malicious GIF images that exploit worm-like vulnerabilities, allowing attackers to take over accounts and infiltrate chat sessions when the image is opened. 

    Hackers also insert malware-laden files into chat threads, tricking users into downloading DLL files that enable system takeover. Phishing campaigns leverage compromised accounts or domains to send deceptive invitations, luring victims into downloading harmful files. 

    Some attackers use email bombing and vishing, posing as tech support to overwhelm users with spam emails before tricking them into granting remote access. Compromised email addresses and stolen Microsoft 365 credentials provide another entry point for unauthorized access. 

    Plus, external access settings in Microsoft Teams, which often allow outside users to initiate chats or meetings, can be exploited if not properly restricted. Another common tactic is sending phishing links through Teams chats, often disguised as invoices or payment notifications, leading to ransomware infections.

    Beware of fake jobs as well

    Scammers have been running fake job schemes for a while, but their tactics keep evolving. Lately, I reported how fake job emails are being used to install crypto mining software that slows down computers. Now, they are using Microsoft Teams chat to trick people. 

    It usually starts with an email about a job followed by a suggestion to do the interview over Teams. The first red flag is that the entire interview happens over chat with no video and no call. After that, you are “hired” and asked to submit your details, often through a Google Doc requesting personal info like your social security or tax number. Some victims are even asked to buy equipment for the job, pay a hiring fee or purchase gift cards, which are classic signs that the whole thing is a scam.

    1) Avoid opening suspicious links and attachments: Be cautious of unsolicited links or attachments, especially in chat messages or emails. Cybercriminals often use these to deliver malware or phishing links. Never click on links that seem unusual or come from unknown sources.

    2) Check for red flags in job offers: If you receive a job offer that seems too good to be true or involves an interview conducted entirely via chat with no phone call or video meeting, it’s likely a scam.     A job offer that insists on only text-based conversations is a major red flag. Other warning signs include being asked to provide personal information through Google Docs, being asked to pay for equipment, paying fees to secure the job or purchasing gift cards as part of the hiring process.

    3) Use strong, unique passwords: Ensure your Microsoft 365 and other accounts are protected with strong passwords. Consider using two-factor authentication to add an extra layer of protection against unauthorized access. Also, you might want to use a password manager to generate and store complex passwords.

    4) Be cautious with personal information: Never share sensitive personal details, like social security numbers or tax information, through unsecured or unsolicited channels, such as Google Docs or messages on Teams. Always verify the legitimacy of such requests.

    5) Report suspicious activity: If you notice any suspicious activity on your Microsoft Teams account or receive unusual job offers, report it immediately. Prompt action can prevent a potential breach or further compromise. Notify your IT department or relevant authorities so they can investigate and take appropriate measures.

    6) Verify IT support requests: Be cautious of unsolicited messages or calls claiming to be from IT support, especially those asking you to install software or grant remote access. Cybercriminals often impersonate IT staff to deploy ransomware or steal sensitive data. Always verify such requests with your actual IT department before taking any action. If in doubt, contact your IT team directly using official channels, not through the message or call you received.

    800,000 noncitizens could soon be voting in New York City’s elections

    New York’s top court will consider a city law allowing noncitizens to register to vote in New York City‘s elections this week.

    The court will hear arguments in the case on Tuesday, with lawyers for Democrats arguing in favor of legislation the city already passed to allow noncitizen voters. If successful, the over 800,000 noncitizens living in the Big Apple would be able to cast ballots in city-level contests like mayoral elections. Proponents of the bill claim noncitizens are being unfairly taxed.

    “In five City Council districts, non-U.S. citizens make up about a third of the adult population,” attorneys for the city wrote in a filing. “These New Yorkers pay billions in taxes and yet have no say in local policies on public safety, garbage collection, or housing — all matters that affect their day-to-day lives.”

    Meanwhile, Republicans in the city are flabbergasted by the effort, pointing to language in the state constitution granting voting rights to “every citizen.”

    The case comes amid a burgeoning race among Democrats to replace New York City Mayor Eric Adams, who remains embroiled in legal trouble.

    The mayor’s office told Fox News Digital last month that despite the new shelter being opened, they are planning to close 46 migrant shelters across the city and reduce the total shelter bed count by 10,000 by June. The city noted that the Hall Street shelter in Brooklyn, one of the largest shelters being closed, housed 3,500 migrants.

    ‘Constitutional crisis’: The Impoundment Control Act takes center stage amid Russell Vought’s confirmation

    A power struggle concerning government spending is heating up in Washington, D.C., igniting what some Senate Democrats call a “constitutional crisis” amid the Trump administration’s efforts to curb government waste. 

    The conflict stems from President Donald Trump’s pick to lead the Office of Management and Budget (OMB), Russell Vought, and was exacerbated when the Trump administration announced it would freeze federal grants and loans on Jan. 27 in an OMB memo. 

    Both Trump and Vought share a common point of contention: the Impoundment Control Act. 

    The 1974 law, which Trump and Vought both argue is unconstitutional, reasserts Congress’ power of the purse and bars the executive branch from unilaterally side-stepping Congress and withholding appropriated funds. 

    However, many legal experts warn that the matter is not up for debate, and the courts are clear; it is unconstitutional for the executive branch to divert dollars Congress has authorized. 

    The Senate voted to confirm Vought on Thursday by a 53–47 margin along party lines, following a 30-hour delay from Democrats in protest against his nomination. 

    Republicans claim that Vought is qualified to lead the department because he previously served in that role during Trump’s first term. Sen. Majority Leader John Thune, R-S.D., said Wednesday that Vought would “be able to hit the ground running.”

    However, Democrats remained staunchly opposed to Vought’s nomination and claimed his views on impoundment disqualified him from the role, with Sen. Richard Blumenthal, D-Conn., arguing on Wednesday that Trump and Vought believe “they may be above the law.” 

    However, what is the Impoundment Control Act? Here is a look at what’s up for debate regarding government spending — and what changes could emerge during the Trump administration. 

    What is the Impoundment Control Act?  

    Article I of the U.S. Constitution grants Congress the authority to manage the federal budget to determine funding decisions to balance power between the branches of government. 

    However, the act of impoundment occurs when the executive branch chooses to not spend these approved dollars from Congress, since the executive branch and the Office of Budget and Management do oversee the actual spending of the approved funds. 

    Should a president want to spend less than what Congress has budgeted, the executive branch must secure approval from Congress. Deferring funds also requires the executive branch to inform Congress. 

    As a result, Congress passed the 1974 Impoundment Control Act to establish these proper channels of congressional oversight if a president chooses to withhold or defer these funds.

    Vought’s opponents voiced concern that his leadership would lead to more cases like the freeze of federal grants and loans disclosed in an OMB memo on Jan. 27, a move that Democrats say was illegal and violated the Impoundment Control Act. 

    “As much as Trump desires it, the president is not a king,” Senate Budget Committee ranking member Jeff Merkley, D-Ore., told reporters on Jan. 28. “As much as Trump desires it, a law is not a suggestion.”

    “These are not questions of opinion,” Merkley said. “These are principles at the heart of our constitutional system. It’s at the heart of our checks and balances, and thus we have a constitutional crisis.”

    ‘This is Congress’ job’

    Vought repeatedly defended his stance that the Impoundment Control Act was unconstitutional in multiple confirmation hearings and claimed that presidents historically could spend less than what Congress had earmarked prior to 1974. 

    Proponents of executive impoundment frequently point to Thomas Jefferson’s administration in 1803, when Congress appropriated funding for 15 gunboats. However, Jefferson held off on purchasing the boats to not aggravate France amid delicate discussions between then-Secretary of State James Madison and Napoleon. The purchase of the boats eventually became unnecessary following the Louisiana Purchase. 

    Additionally, Vought’s Center for Renewing America, a nonprofit Vought founded in 2021, has said impoundment allows the executive branch to exert fiscal discipline and that the president has the authority to determine if funds are used in the most efficient manner. 

    Vought did not respond to a request for comment from Fox News Digital. 

    However, according to multiple legal experts, the Constitution and the courts are clear that spending appropriations fall under the parameters of the legislative branch. 

    Michael McConnell, director of the Constitutional Law Center at Stanford Law School, told Fox News Digital, “The president has the constitutional obligation to take care that the laws be faithfully executed, and that includes spending.

    “So I don’t know where Mr. Vought gets the view that somehow the president has the right to decide what the government is going to spend money on,” he said. “This is Congress’ job.”

    Despite Trump and Vought’s views that the Impoundment Control Act is unconstitutional, McConnell said that he believed there is “no reasonable prospect that the court is going to agree with that.

    “The person who would have been the recipient of the funding will have some standing to sue,” McConnell said. “So, I would assume that if there’s an impoundment, there will be an immediate lawsuit under the Impoundment Control Act.” 

    TRUMP TREASURY PICK: EXTENDING TRUMP TAX CUTS ‘SINGLE MOST IMPORTANT ECONOMIC ISSUE’

    Other legal experts agreed that should the Trump administration attempt to withhold funds, the courts would step in and assert that there is no legal basis to do so. 

    That is because this is not a murky legal issue, according to Georgetown Law professor Stephen Vladeck. 

    “There are contested issues of constitutional law, but this just isn’t one of them,” Vladeck told Fox News Digital. “Were it otherwise, there wouldn’t be much point in having a legislative branch.”

    Legal experts claim the courts historically have upheld the constitutionality of the Impoundment Control Act, and point to the 1975 case Train v. City of New York. In that case, the Supreme Court determined the Environmental Protection Agency must use full funding included in the Federal Water Pollution Control Act Amendments of 1972, even though then-President Richard Nixon issued orders not to use all the funding.

    Vought himself admitted in a Jan. 22 confirmation hearing that no court of law has found the Impoundment Control Act unconstitutional. 

    Fallout from the OMB memo  

    The courts did step into action following the recent OMB memo outlining a pause in federal grants and loans, and two federal judges have temporarily blocked the freeze. 

    Although the White House did rescind the memo pausing the federal aid on Jan. 29, White House press secretary Karoline Leavitt said that the move did not equate to a “rescission of the federal funding freeze.” 

    The White House did not respond to a request for comment from Fox News Digital on Vought’s nomination and comments from Democrats that the memo was “illegal.” 

    The memo did not appear to alarm Republican leadership in Congress, who publicly characterized the pause as standard protocol during an administrative turnover. 

    “I think that’s a normal practice at the beginning of administration, until they have an opportunity to review how the money is being spent,” Senate Majority Leader John Thune, R-S.D., told reporters on Jan. 27. “We’ll see kind of what the extent of it is, and … what they intend to do in a more fulsome way. But for now, I think it’s just, it’s just kind of a preliminary step that I think most administrations take,” Thune said. 

    House Speaker Mike Johnson, R-La., also told reporters on Jan. 27 the memo did not concern him and that he “fully” supported it, labeling the directive a “common application of common sense.”

    Even so, the memo further intensified opposition to Vought’s nomination. Specifically, Democrats urged the entire Senate to reject Vought’s nomination on Jan. 30 in response, following a committee vote advancing his nomination to the Senate floor. 

    Merkely noted that Vought oversaw the OMB in 2019 when the office held up $214 million in military aid for Ukraine — an issue that emerged as a key point in Trump’s first impeachment. Ultimately, the Government Accountability Office determined in 2020 the move did violate the Impoundment Control Act, ahead of Trump’s Senate impeachment trial. The Senate ultimately voted to acquit Trump.

    Therefore, Merkley characterized Vought as “dangerously unfit” to lead OMB and a “dangerous threat to our constitutional system of representative democracy.” 

    Josh Chafetz, a professor at Georgetown Law, said such language such as “constitutional crisis” is reasonable considering Congress’s spending power is one of the few but critical ways the legislative branch ensures the executive branch doesn’t exert too much power. 

    “These kinds of impoundments are not just unconstitutional, but they’re actually anti-constitutional,” Chafetz told Fox News Digital. “They strike at the very foundation of our constitutional order.”

    Reform on the horizon?

    Democrats also don’t believe the recent memo is an isolated incident. Sen. Minority Leader Chuck Schumer, D-N.Y. cautioned on Jan. 30 that Vought would seek to withhold funds again overseeing OMB — if the Senate confirms him. 

    Vought himself signaled the Trump administration could initiate reform on impoundment law. In a confirmation hearing on Jan. 22, Vought told lawmakers that while an exact strategy is not intact yet, the Trump administration plans to complete a review with the Justice Department to explore the “parameters of the law with regard to the Impoundment Control Act,” should the Senate confirm him.

    Vought also noted that some lawmakers who agree with his position on impoundment have proposed legislation on the matter. For example, Sen. Mike Lee, R-Utah, introduced legislation in December 2024 to repeal the Impoundment Control Act, arguing that the law’s “unconstitutional limitations” on the executive branch have “contributed to a fiscal crisis.”

    While many legal experts agree the legislative branch is the proper channel for reforming the Impoundment Control Act, Chafetz doubts there is an appetite to do so and that lawmakers on both sides of the aisle would ultimately view such attempts as an “attack on their institution.”
